Supreme Court organised a civil law seminar with German colleagues
At a joint seminar members of the Civil Chamber of the Supreme Court of Estonia met with a delegation from the 5th Civil Senate of the Federal Court of Justice of Germany, with whom they discussed civil law issues important to both courts.
The purpose of the visit by the five-member delegation from the Federal Court of Justice (Bundesgerichtshof, BGH) between the 12th and 14th of May 2026 was to discuss key legal issues facing the courts. The 5th Civil Senate of the BGH specializes, among other things, in disputes arising from real estate sales contracts and property law disputes, including apartment ownership, co-ownership, neighbor law, right of access, and land register law. Therefore, the event focused on challenging issues recently resolved by the courts as well as those facing them in the future.
The discussions primarily addressed current themes concerning apartment owners' claims and their enforcement, apartment owners' liability, real estate sellers' liability, access fees, as well as matters related to cassation proceedings. Among other topics, the participants also discussed issues related to the use of artificial intelligence—how digitalization and artificial intelligence affect court proceedings both now and in the future, and whether they help enhance the quality of the administration of justice.
Kaupo Paal, Chairman of the Civil Chamber, noted that the multi-day seminar was extremely beneficial for the members of the chamber. „According to the German justices, it was surprising that the very same problems are current in Estonia as they are in Germany,“ Paal said.
